And about the free speech thing, I was always under the impression that free speech meant you could say what you want (excluding threats) w/o any form punishment...or that's what we were tricked into believing anyway.
Calling the cop a fvcking dick, or flipping a cop off without any physical contact, are both considered actionable threats in the eyes of the law. Free speech gets shut down when it poses an immediate danger of escalating the violence toward the officer.
The cop was unprofessional by instigating this whole thing with the headache remarks, but Junior needs to remember there are "inside words" and "outside words." Save the editorials for when the cop is gone.
Its so simple, a word of advice to the youngsters out there in TV land:
KEEP YOU FRIGIN MOUTH SHUT, SAY 'YES, SIR', 'YES, SIR', and 'YES, SIR'.
Then you might not have to spend the night in a dungeon most cities call 'City Jail', these places are typically the grossest jails in the country (and you'll prolly be there a good 24 hrs before you can see the judge to get out).
After the cop lets you go, cause you shined him on real good by being nice, then you and your friends skate away singing 'F da Police, F da Police' and complete an excellent session in freedom and the company of friends. Now dats how you do it, son.
calling a cop an asshole isn't against the law and while it's not smart, it's not illegal.
the cop threatened him, plain and simple. To KD, he didn't word it differently. what he said was a threat of physical violence, which IS ILLEGAL, cop or not.
this whole "mature, holier than thou" 'longboarder' attitude is just plain laughable, especially from a bunch of old has-been/never-were's... you cats are pretty pathetic
and before any of you ladies get your panties bunched up anymore, in no way am i saying him getting arrested was "wrong". Most skaters are prepared to spend a couple hours locked up, it goes with the territory..
Just the fact that the douchebag with the badge thought he needed to act all big and bad and threaten (and apparently KICK) the kid that was clearly not a threat. Which on top of abusing his power, is a crime. He's got no excuses, and no valid reasons for his actions.
Yeah calling a cop an F'ing D!ck isn't smart and I never said it was illegal. Skating in that location and pulling grates IS !
As for the rest of your post , It's not worth taking the time to respond to.

go to jail. try to eat the "cheese" and "bread" and mayo packets. get constipated. get out of jail. learn a lesson.
OR
don't be retarded like me, listen to GrassDriver.
oh and for that retarded guy from brooklyn, cops will see respect when they cease doing things such as...
talking to a "witness" in spanish, then handcuffing you because the "witness" said you were driving a state-owned trashcart (that you were riding on). then you read the police report and everything you said was written in it but nothing of the 5 minute conversation in another language was written (that falsely incriminated you). then you go to jail, miss an exam, have to drop the class, and get to pay thousands in lawyer fees.
the police will always be the enemy! they're bread from swine and feces. they just NEED to protect you from yourself, isnt there a bank being robbed or a child being beaten, go do something that actually matters pigs! skateboarding is not a crime, its a sport.

Most accurate and helpful post. Anything vs. cop is a probable loss when aggression is employed. That is just the way it works. If that kid didn't think calling that cop a dick would elicite a negative response, then he's retarded. You can do whatever you want to a cop. Just man up when the bill comes. That being said, some cops are dicks. Some skaters are dicks. Nobody posts videos of cops being cool. Not interesting enough for our inate desire to hate something.

The cop was unprofessional by instigating this whole thing with the headache remarks,
Really?
Why do people act like this is instigation? They are skateboarders without helmets, for all we know the cop saw him fall down. If a guy is sitting on a curb rubbing his head it's perfectly reasonable to ask if he has a headache. To me it showed that he gave a damn about the kid's possible headache.
Asking someone if they have a headache "them ain't fightin words."
I think at no point was he out of line. When he made the statement about arm breaking it did something very specific. It made that kid soft and pliable and it didn't take much time. That's clever. He used very basic intimidation to enforce his status, and the kid fell into place because of it.
Yes Rivieri is a douche, and yes choke-slam cop is a douche, but these are different.

If the cop never said, "Ashamed of yourself?" the kid never would have called him a dick. It was a jackass move on the cop's part.

In that situation, that cop didn't know these kids. He was 1 man, surrounded by a bunch of punk kids. Not that he couldn't have beat up anyone of them individually. But, at any time, one of them could have come up from behind him and smashed him in the skull with a rock or their skateboard.
It happens all the time. They train officers in the academy to take control of a situation like that. The safety of the officer is of utmost importance. Taking control of a situation where there's 1 cops surrounded by 8 punks requires a direct approach.
Similar to that of when being attacked by a group of dogs. You point at those dogs as they're approaching and begin yelling at them. "No!!" "Sit!!" "Stop!!". That's the best defense against a pack.
Take charge, yell, take command, take control.
That's what the cop did and he was in the right.
As far as what he was taught, those kids could have killed him if he acted nice and subservient.
Why are they punk kids? Because they ride skateboards? They all remained quiet the whole time except for one after the cop made the headache comment. He knew they weren't a threat. Come on...
I said "punk kids" only because the academy teaches them that EVERYONE'S a punk.........first.........only a good citizen when proven one.
Guilty until proven innocent, so to speak.
I'm not a cop, I only hear my sister and her husband talk about this stuff all the time.
But, yeah, the cop really started it. He knew why the kid was holding his head, then provoked him. Never fall prey to any cops BS. I hope that kids learned to shrug it off next time.
I got tackled from behind when I was about 22 years old because I gave a cop car the finger.
They sited me for disrespecting an officer and unsatisfactory public conduct.........or some senseless BS like that. My parent's had to come pick me up from the station. That was when I lived in Easton, PA.
Remember that there are a thousand laws that were written vaguely for the sole purpose of giving officials the ability to charge someone with for doing just about anything. Nobody knows about these laws because they are so minor in nature. But, they do exist.
